Terms of use of the online store www.medikom.lv of SIA "Medikom Latvia".

The given regulations determine SIA "Medikom Latvia", reg. No. 40103455640, legal address: Zentenes street 5-58, Riga, LV-1069, actual address: Mukusalas street 72B, Riga, LV-1004 online store (hereinafter referred to as OS) www.medikom.lv terms of use, including terms of delivery and return of goods, right of withdrawal. The given terms and conditions may be supplemented or changed without prior notice and are binding on any OS user. By using the OS website and/or making a purchase/order, you (the Buyer – a natural or legal person) confirm that you have read, understand and agree to the given terms, as well as undertake to comply with them.

Mutual compliance with the rules given (SIA "Medikom Latvia" and the Buyer) and making a purchase/order is considered a Distance Contract within the meaning of the Latvian Cabinet of Ministers No. 255 of 20 May 2014 "Regulations on Distance Contracts" and the Consumer Rights Protection Law. The distance contract enters into force at the moment when the Buyer has selected the purchase, agreed to the given terms, paid for the purchase and received the purchase.

 The right to use the online store and purchase goods

OS is available to any natural and legal person who agrees to the given terms, privacy policy and processing of personal data stipulated in the given terms.

The importance of the information available in the online store

The information and descriptions available on goods of medical significance, their purposes of use and the health problems in which the goods in question are to be considered for use are to be considered for information only. This information does not replace the recommendation of a medical professional, nor does it constitute a medical consultation/recommendation. In case there are doubts about the use of a product of medical significance, please consult a medical professional. SIA "Medikom Latvia" does not bear responsibility for possible losses or damages incurred by relying on the information available to the OS.

Placing an order/purchase

In order to place an order/purchase in the OS, the Buyer chooses the goods to be ordered/purchased from the range of goods available to the OS, their size (if several sizes are available) and quantity. The selected items are added to the basket. At this stage, the goods selected by the Buyer have not yet been booked and can be purchased by other buyers. From now on, the Buyer follows the steps incorporated by the OS and takes appropriate actions – including indicating the information necessary for placing an order/purchase and concluding a Distance Contract – the Buyer's contact information and delivery address, method of delivery. The specified information is processed in accordance with the OS Privacy Policy. The Buyer shall be responsible for the accuracy of the specified information.

In order to complete the order/purchase and pay for it, the Buyer follows the steps of the payment solution incorporated by the OS. It is possible to pay for the goods to be ordered/purchased by the OS with payment cards, as well as to make online payments via Internet banking. Depending on the payment method chosen by the Buyer, additional information related to the payment of the order/purchase may be requested from the Buyer to carry out the transaction. Upon completion of the payment process, the Buyer has ensured the payment of his/her order/purchase.

After completion of the order/purchase payment process, an informative confirmation e-mail with the details of the order/purchase will be automatically sent to the e-mail address specified by the Buyer.

Payment processing is provided by the payment  platform makecommerce.lv, therefore our company transfers the personal data necessary for the execution of payments to the owner of the platform Maksekeskus AS.

Medical goods available in the online store.

SIA "Medikom Latvia" is not the manufacturer of the goods of medical significance offered by the OS. All prices are in Euro (EUR) for the OS. The price includes value added tax (VAT) and other taxes, if applicable.

The price of the goods does not include the cost of delivery of the goods, which may vary depending on the type of delivery and the distance to be delivered from the warehouse in Riga, Latvia.

 Delivery of goods

SIA "Medikom Latvia" OS provides the ordered/purchased goods, while the delivery of the goods is carried out by the cooperation partners of SIA "Medikom Latvia" – logistics service providers. At the time of placing the order/purchase, the Buyer chooses the appropriate method of delivery of the goods from the variants incorporated in the OS. The fee for the delivery service of the goods selected by the Buyer is added to the order/purchase amount.

Shipment of the product to the Buyer shall take place no later than within the next working day after the date of placing the order/purchase of the product, provided that the product is available at the warehouse, otherwise the Buyer will be informed about the absence of the product in the warehouse at the time of placing the order/purchase. In this case, the shipment of the goods to the Buyer takes place on the next working day after the date of receipt of the goods at the warehouse.

The Buyer is informed about the terms of delivery of the goods according to the chosen method of delivery and agrees to them at the time of placing the order / purchase. SIA "Medikom Latvia" does not take responsibility for the possible delay in the delivery of goods due to the fault of cooperation partners – logistics service providers, but SIA "Medikom Latvia" for its part undertakes to take the necessary actions to resolve the situation and ensure the Buyer's receipt of the goods as soon as possible.

The buyer is obliged to ensure the receipt of the goods personally or through an authorized person. If necessary, the Buyer must verify the conformity and quality of the goods at the time of delivery, sign the appropriate documents related to the execution of the order / purchase (e.g. bill of lading or other delivery document).

If the Buyer finds that the delivered product is damaged, the Buyer shall indicate this fact in the copy of the delivery document of the Seller (SIA "Medikom Latvia"). If the delivery has taken place via a parcel machine, the Buyer shall immediately notify the Seller about the damaged product by writing an e-mail to the address: dace@medikom.lv. If the Buyer does not report the damage to the received product at the time of receipt, it is considered that the Buyer has received the product undamaged.

From the moment of receipt, the product is the responsibility of the Buyer and SIA "Medikom Latvia" does not bear responsibility for damage to the product that has occurred after the delivery has been completed.

Return of goods. Right of withdrawal.

 In accordance with the Latvian Cabinet of Ministers Regulation No. 255 of 20 May 2014 "Regulations on Distance Contracts", the Buyer – a natural person has the opportunity to exercise the right of withdrawal within 14 days from the moment of receipt of the goods. In order to exercise the right of withdrawal, the Buyer must fill in  the Consumer Withdrawal form available here. After filling  in the form, it must be signed with an electronic signature and sent to the e-mail address dace@medikom.lv  In case the Buyer does not have an electronic signature – the form must be signed physically and sent in a scanned form to the e-mail address dace@medikom.lv If within 14 days from the moment of receipt of the goods / goods SIA "Medikom Latvia" has not received the completed and signed Consumer Withdrawal Right of Form, the further right of withdrawal for the Buyer shall disappear.

Buyer – a natural person may exercise the right of return if:

The product / goods are not used, their packaging is preserved and not damaged.

The product / goods are fully assembled, including with all accompanying documents.

Buyer – a natural person may not exercise the right of withdrawal if:

Personal hygiene products/products have been purchased and their packaging has been opened;

The purchased goods/goods are perishable or can be used quickly;

Purchased goods / goods that are not returnable in accordance with the regulatory enactments of the Republic of Latvia.

After sending the withdrawal form, the Buyer is obliged to return the product / goods to SIA "Medikom Latvia" within 7 days by sending them to the warehouse address of SIA "Medikom Latvia" - Mukusalas Street 72B, Riga, LV-1004 or by sending them to the parcel machine – Riga T/C Riga Plaza parcel machine, indicating the following information about the recipient:

The costs related to the return of the product / goods shall be borne by the Buyer, as well as the delivery costs for the receipt of the product / goods shall not be returned to the Buyer, only the purchase value of the product / goods. In the event that SIA "Medikom Latvia" has not received the returned product / goods within 7 days from the receipt of the withdrawal form, it is considered that the Buyer has changed his mind regarding the return of purchases. In the event that the product / goods are returned to SIA "Medikom Latvia" later than 7 days after sending the withdrawal form, it is considered that the product / goods remain the property of the Buyer and the funds for the purchased product / goods are not returned. In this case, the purchased goods/goods are stored in the warehouse of SIA "Medikom Latvia" for one year from the moment of their return – the moment of receipt, giving the Buyer the opportunity to pick them up by arriving in person or by agreeing on their shipment. If the purchased but late returned goods/goods are not removed by the Buyer within one year from the moment of their return, the product / goods shall be disposed of and further claims of the Buyer shall not be considered.

According to the Republic of Latvia Consumer Rights Protection Law, "the consumer is responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal". Consequently, SIA "Medikom Latvia" reserves the right to refuse to use the right of withdrawal or to withhold a compensation fee if it is established that the product / goods are damaged, used, the original packaging of the goods / goods has disappeared or it is significantly damaged.

SIA "Medikom Latvia" does not control and is not responsible for the content of the mentioned websites. The above links have been created in order to provide the Buyer with additional information and convenience as necessary.

Limited Liability

SIA "Medikom Latvia" undertakes to take all necessary actions to ensure continuous and infallible operation of the OS and to provide the Buyer with the opportunity to purchase and receive the goods / goods in a timely manner, however, SIA "Medikom Latvia" does not assume responsibility for any indirect, accidental or sequential losses and inconveniences related to possible incomplete operation of the OS.

 Copyright in Content OS

All content of OS – is considered to be the intellectual property of the producers of goods offered by SIA "Medikom Latvia" or OS. Reproduction, republishing of any kind of content in full or in part is not allowed without the permission of SIA "Medikom Latvia".

Procedure for the settlement of disputes and disputes

Any disagreements and disputes are resolved through negotiations.

If it is not possible to resolve the dispute or dispute through negotiations, both the Buyer and SIA "Medikom Latvia" have the right to apply to one of the courts of the Republic of Latvia for consideration of the issue. The buyer also has the right to apply to the Consumer Rights Protection Centre, 157 Kr. Valdemara Street, Riga, LV-1013.

Force majeure

SIA "Medikom Latvia" is not responsible for the delayed fulfillment or non-fulfillment of its obligations, which has arisen due to extraordinary circumstances beyond the control of SIA "Medikom Latvia". This includes, but is not limited to, strikes, hostilities, environmental and climate anomalies, terrorism, government orders, states of emergency, third-party actions, disruptions to computers/software.
